1. Introduction
Welcome to Mylynks. These Terms of Use (the “Terms”) govern your access to and use
of the Mylynks website, applications, and related services (collectively, the “Services”).
By accessing or using the Services, you agree to be bound by these Terms. If you do
not agree to these Terms, you must not access or use the Services.
2. Definitions
For purposes of these Terms: “Company,” “Mylynks,” “we,” “our,” and “us” mean Mylynks
and its affiliates. “You” and “your” mean the individual who accesses or uses the
Services, and, as applicable, any organization on whose behalf you do so. “Referral
Services” means the functionality through which Mylynks may provide information
about, or introduce users to, independent third-party service providers (“Third-Party
Providers”).
3. Eligibility and Accounts
You must be at least the age of majority in your place of residence and have the legal
capacity to enter into these Terms. If you create an account, you agree to provide
accurate, current, and complete information and to keep it updated. You are responsible
for maintaining the confidentiality of your login credentials and for all activities under
your account.
4. Use of the Services
You may use the Services only for lawful purposes and in accordance with these Terms.
You agree not to: (a) misrepresent your identity or affiliations; (b) interfere with or disrupt
the operation or security of the Services; (c) reverse engineer, decompile, or attempt to
derive the source code of the Services; (d) use any automated means to access the
Services without our prior written permission; (e) upload or transmit malicious code; or
(f) use the Services in any manner that infringes, misappropriates, or violates any rights
of any person or entity.
5. Referral Services and Third-Party Providers
Mylynks may connect you with Third-Party Providers or provide information that helps
you identify such providers. Third-Party Providers are independent contractors and are
not employees, agents, joint venturers, or partners of Mylynks. Mylynks does not
control, endorse, or guarantee any Third-Party Provider, their qualifications, availability,
pricing, insurance, licensure, or the quality, safety, legality, or suitability of their services.
Any engagement between you and a Third-Party Provider is solely between you and
that provider, and your use of a Third-Party Provider’s services is at your own risk.
Mylynks is not a party to, and will have no liability for, any agreements, transactions,
communications, disputes, acts, or omissions between you and any Third-Party
Provider.
6. Fair Housing Law Compliance
Users must comply with all applicable fair housing and anti-discrimination laws,
including but not limited to prohibitions on discriminatory advertising, steering,
blockbusting, redlining, and other unlawful practices. You must not use the Services to
request, promote, or facilitate any discriminatory conduct. Mylynks does not tolerate
discrimination and may suspend or terminate access to the Services for violations or
suspected violations of applicable fair housing or anti-discrimination laws.
7. User Content
If you submit, upload, or otherwise provide content or information (“User Content”), you
represent and warrant that you own or have all necessary rights to such User Content
and that it does not violate any law or rights of any third party. You grant Mylynks a
nonexclusive, worldwide, royalty-free license to host, store, reproduce, display, and
otherwise use your User Content solely to operate and improve the Services. Mylynks
may remove or disable access to any User Content that it believes violates these Terms
or applicable law.
8. No Professional Advice
The Services may provide information, including about Third-Party Providers, that is
general in nature and for informational purposes only. Mylynks does not provide
professional, legal, financial, housing, or other regulated advice. You are solely
responsible for your decisions and should seek independent professional advice as
appropriate.
9. Intellectual Property
The Services and all content therein, including text, graphics, logos, icons, images,
software, and other materials, are owned by or licensed to Mylynks and are protected
by intellectual property laws. Except as expressly permitted by these Terms, you may
not copy, modify, distribute, sell, lease, or create derivative works from any part of the
Services without our prior written consent.
10. Feedback
If you provide feedback, comments, or suggestions regarding the Services
(“Feedback”), you grant Mylynks an unrestricted, perpetual, irrevocable, worldwide,
royalty-free right to use the Feedback for any purpose without compensation or
attribution to you.
11. Disclaimers
The Services are provided on an “as is” and “as available” basis. To the maximum
extent permitted by law, Mylynks disclaims all warranties, whether express, implied,
statutory, or otherwise, including any implied warranties of merchantability, fitness for a
particular purpose, title, and non-infringement, and any warranties arising out of course
of dealing or usage of trade. Mylynks does not warrant that the Services will be
uninterrupted, error-free, secure, accurate, or complete.
12. Limitation of Liability
To the maximum extent permitted by law, in no event will Mylynks be liable for any
indirect, incidental, special, consequential, exemplary, or punitive damages, or for any
loss of profits, revenues, data, goodwill, or other intangible losses, arising out of or
related to your use of or inability to use the Services or any Third-Party Provider’s
services, even if advised of the possibility of such damages. To the maximum extent
permitted by law, Mylynks’ total liability for any claim arising out of or relating to the
Services will not exceed the greater of one hundred dollars (USD $100) or the amount
you paid to Mylynks for the Services in the twelve months preceding the event giving
rise to the claim.
13. Indemnification
You agree to defend, indemnify, and hold harmless Mylynks and its affiliates, and their
respective officers, directors, employees, and agents, from and against all claims,
liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising
out of or in any way connected with: (a) your access to or use of the Services; (b) your
User Content; (c) your violation of these Terms or applicable law; or (d) your interactions
with, or reliance upon, any Third-Party Provider.
14. Suspension and Termination
We may suspend or terminate your access to the Services at any time, with or without
notice, if we believe you have violated these Terms or applicable law, or for any other
reason in our discretion. Upon termination, your right to use the Services will
immediately cease.
15. Changes to the Services and to these Terms
We may update, modify, or discontinue all or any part of the Services at any time
without notice. We may also revise these Terms from time to time by posting the
updated Terms on the Services with a new “Last Updated” date. Your continued use of
the Services after any changes constitutes your acceptance of the revised Terms.
16. Governing Law; Dispute Resolution
These Terms will be governed by and construed in accordance with the laws of the
State of Arkansas, without regard to conflict of laws principles. Before initiating formal
proceedings, you agree to first attempt to resolve any dispute with Mylynks informally by
contacting us at the information below. If we cannot resolve the dispute within thirty
days, disputes will be resolved exclusively in the state or federal courts located in
Washington County, Arkansas, and you consent to the personal jurisdiction and venue
of such courts. To the extent permitted by law, you and Mylynks waive the right to a jury
trial and to participate in a class, collective, or representative action.
17. Electronic Communications; Notices
By using the Services, you consent to receiving electronic communications from us.
Notices may be provided by posting to the Services, by email to the address associated
with your account, or by other reasonable means.
18. Severability; Entire Agreement; Assignment
If any provision of these Terms is held invalid, the remaining provisions will remain in full
force and effect. These Terms constitute the entire agreement between you and
Mylynks regarding the Services, and supersede all prior or contemporaneous
agreements on the subject matter. You may not assign or transfer these Terms without
our prior written consent. We may assign these Terms without restriction.
